WEBSITE ORDER AGREEMENT

By placing an order for website design, setup, and maintenance services (the "Services") through Actuated Marketing ("AtM" or "Company"),
You (the "Client") by placing the order and paying the setup fee of the website, thereby acknowledge that you have read, understand, and agree to be bound by the terms and conditions outlined below.

1. SERVICES

AtM will provide website design, setup, and maintenance services as described on the order form.

2. PAYMENT TERMS

Client agrees to pay the fees outlined on the order form. The effective date of this agreement shall be the date payment is processed.

3. TERM AND TERMINATION

The term of this agreement shall commence on the effective date and continue on a month-to-month or yearly basis, depending on the selected payment option, until terminated by either party with written notice provided 30 days before the renewal of the payment.

4. SATISFACTION GUARANTEE

AtM offers a 100% satisfaction guarantee. Within 30 days of the website launch, Client may request changes or cancel the agreement. If Client is still not satisfied after changes are made, AtM will refund the website fee and cancel the plan and website.

5. ARBITRATION

Any disputes arising from this agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association in Oklahoma County, Oklahoma.

6. CLIENT RESPONSIBILITY

Client is responsible for providing content and information necessary for the website design and setup.

7. COMPANY RIGHTS

AtM reserves the right to decline or terminate any client relationship at its discretion.

AtM Owns the software used to make the website, the software used on the website, including ADA Compliance, and does not offer ownership of said software(s) to the Client.

8. OWNERSHIP AND JOINT PARTNERSHIP

Upon termination or decline, AtM will transfer ownership of the website base html to Client, minus features, software and services provided by AtM, per section 7 above.

8.1 Joint Partnership for Website Services

Actuated Marketing (AtM) and Client agree to a joint partnership for the sole purpose of designing, setting up, and maintaining the Client's website (the "Website").

This partnership is limited to the scope of work outlined in the order form and does not imply or create a joint venture, partnership, or ownership interest in either company.

8.2 Cooperation and Mutual Benefit

Both parties agree to cooperate and work together to achieve the goals and objectives of the Website.

This partnership is intended to be mutually beneficial, enhancing the online presence and marketing efforts of the Client.

8.3 No Ownership or Control

Neither party shall have any ownership or control over the other's business, assets, or intellectual property. This partnership is limited to the Website services outlined in the order form.

8.4 Confidentiality

Both parties agree to maintain the confidentiality of each other's proprietary information, trade secrets, and sensitive data.

9. GOVERNING LAW

This agreement will be governed by and construed in accordance with the laws of the State of Oklahoma.

By placing an order, you acknowledge acceptance of this Website Order Agreement.
